CHALLENGER PORTFOLIO TRADE INCENTIVE 2025

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to selected on-premise venues in Australia invited by the Promoter to participate in this promotion (each an “Eligible Venue”).
  3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Registration

  5. Registration into the promotion commences on 03/02/2025 and registrations close at 11:59pm AEDT on 27/04/2025 (“Registration Period”).
  6. At the commencement of the Registration Period, the Promoter's sales representatives will invite Eligible Venues to participate in the promotion. Sales representatives will provide each Eligible Venue with a trade presenter that outlines the details of this promotion, including a URL that can be used to register. To register, an authorised representative on behalf of an Eligible Venue (“Authorised Person”) must visit the URL and supply their valid email address, contact number, venue name, venue contact and the Eligible Venue's capacity classification (being either: a) a maximum of 150; or b) a capacity of 151 or more), when prompted. Alternatively, an Authorised Person can send an email to [email protected] with their venue name and their Eligible Venue's capacity. All Eligible Venues must be registered to participate by 11:59pm AEDT on 27/04/2025 at the latest.
  7. Eligible Venues will be divided into two (2) groups depending on their capacity, either capacity of up to 150 people (“Group 1”) or a capacity of 151 people or more (“Group 2”). There will be a separate prize pool of prizes to be won per group.
  8. How to Participate

  9. To participate in this promotion, an Authorised Person, on behalf of an Eligible Venue, must purchase eligible products, via a participating wholesaler (being Paramount, ALM, ILG, Bidfood and Liquidmix – each a “Participating Wholesaler”), between 03/02/2025 and 11:59pm AEST on 11/05/2025 (“Purchase Period”). For clarity all eligible purchases made by an Eligible Venue during the Purchase Period will be accepted, regardless of when the Eligible Venue registers, provided registration is completed by 11:59pm AEDT on 27/04/2025.
  10. Eligible Venues will earn points (“Points”) for each eligible product purchased during the Purchase Period as follows:

  12. Eligible Venues must retain purchase receipt(s)/invoices for all eligible products purchased as proof of purchase. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Venue's Points and forfeiture of any right to a prize. Purchase receipt(s)/invoice(s) must clearly specify the eligible product/s purchased, the Participating Wholesaler of purchase and that the purchase was made during the Purchase Period.
  13. Bonus Points

  14. There will be various photo challenges that each Eligible Venue can complete (each a “Challenge”) to earn additional Points (“Bonus Points”). To participate in the Challenges, Eligible Venues must hold an Instagram account associated with the Eligible Venue (personal / staff Instagram accounts will not be accepted) of which at least 80% of subscribers are over the legal purchase age for alcohol. Eligible Venues that participate and complete a Challenge, by the time indicated, will be entitled to earn Bonus Points in accordance with the table below. Eligible Venues will need to submit proof of completing a Challenge, by uploading the photo content (“Photo”) to the Eligible Venue's Instagram account by the time indicated in the table below. Eligible Venues that register between 03/03/2025 and 14/04/2025 will not be eligible to participate in any Challenge/s that have already closed (as detailed below). Challenges to be completed and the Bonus Points available are as follows:

  16. Content Rules: All Photos must be posted to the Eligible Venue's Instagram account. Entries posted to personal/staff Instagram accounts will not be accepted. Photos must be of the physical cocktail created or of the menu where the cocktail is listed and must list all ingredients featured. All Photos must have the relevant product for that Challenge in the Photo and also feature a De Kuyper product in order to earn additional Bonus Points. A maximum of 150 additional Bonus Points for featuring a De Kuyper product per Challenge, regardless of how many De Kuyper product/s are used in the making of the cocktail. The Instagram Post must either tag the relevant brand/s associated with the Challenge or be mentioned in the caption of the post. The Instagram Post must state #AD in the caption. Eligible Venues must also ensure that no person is pictured in any Photo uploaded for the purposes of this promotion. The Instagram Post must comply with the Promoter's User Generated Content Policy, which applies to all brands included in this Promotion and is available at: https://www.williamgrant.com/gb/user-generated-content-policy/. If the Eligible Venue posts any Photos or Instagram posts which do not comply with the Content Rules or any other clause of these Terms and Conditions, the Promoter reserves the right to discount the Photo, to ask the Eligible Venue to take down the post, and/or (depending on the circumstances) to disqualify the Eligible Venue from the Promotion. Eligible Venues must take down any posts upon request by the Promoter.
  17. Eligible Venues are only permitted to submit one (1) Photo per Challenge. If multiple Photos are submitted, only the first Photo will be considered for the purposes of this promotion.
  18. Winner Determination

  19. At the end of the Purchase Period, Eligible Venues will be divided into two (2) groups, for the purposes of awarding prizes (as outlined below), being Eligible Venues with a venue capacity of a maximum of 150 and Eligible Venues with a venue capacity of 151 or more (each a “Group”). The Promoter will purchase the sales data from the relevant Participating Wholesalers, and will use this data to monitor the stock purchases of the Eligible Venues participating throughout the Promotional Period. For clarity, the Promoter can only access the data relating to the brands within the William Grant & Sons portfolio. The Promoter will then tally the number of Points (including Bonus Points) accumulated by each Eligible Venue in each Group. The Eligible Venues with the highest score of Points, in each Group, at the end of the Promotional Period will each win a prize as outlined below. In the event of a tie between two (2) or more Eligible Venues with the same highest number of Points for a particular prize, the Promoter will review the Instagram Photos posted by the tied Eligible Venues (for the purposes of this promotion) and award the prize to the Eligible Venue with the most overall engagement (specifically, the total number of comments and likes across all posts). Eligible Venues may need to share certain data with the Promoter in order to verify their engagement.
  20. Winner Announcement & Contact Dates

  21. Winning Eligible Venues will be posted to the website on 27/05/2025, and they will be contacted via the email address and phone number that was provided at the time of registration by 29/05/2025.
  22. The Eligible Venue with the highest Points score, in each Group, will each win the major prize (“Major Prize”).
  23. The Eligible Venue with the second highest Point, in each Group, will each win the second prize (“Second Prize”).
  24. The Eligible Venue with the third highest Point, in each Group, will each win the third prize (“Third Prize”).
  25. The Eligible Venue with the fourth highest Point, in each Group, will each win the fourth prize (“Fourth Prize”).
  26. The Eligible Venue with the fifth highest Point, in each Group, will each win the fifth prize (“Fifth Prize”).
  27. Each prize (excluding any cash prize) will be awarded to the owner/manager of the winning Eligible Venue who may in their absolute discretion, allocate the prize to employees of the Eligible Venue of their choice (each a “Prize Recipient”). The owner/manager of the winning Eligible Venue must notify the Promoter of that transfer (in writing) by 05/06/2025 and must not issue a prize without the Promoter's approval. Prize Recipients must meet any age limitations that may apply to the prize. Prize Recipients and (if applicable) their guests must not do anything which could, in the reasonable opinion of the Promoter, bring the Promoter or its brand into disrepute before, during or after this promotion.
  28. Major Prize

  29. Each Major Prize is a trip for two (2) adults aged 25 years or over to New Orleans, USA to attend The Tales of the Cocktail 2025 event between 19/07/2025 and 26/07/2025, valued at up to AU$44,100 depending on point of departure.
  30. Each Major Prize is for two (2) adults aged 25 years or over and includes:
    • Two (2) x return economy airfares from the Australian capital city nearest the winning Eligible Venue to New Orleans, USA;
    • Private airport to hotel transfers for four (4);
    • Seven (7) nights single share minimum 3star accommodation in New Orleans with breakfast included daily;
    • Access to The Tales of the Cocktail 2025 seminars tasting rooms and events provided by the Promoter;
    • $100 USD spending money per person per day; and
    • International travel insurance (subject to the travellers having no pre-existing medical conditions and being under the age of 59 years).

    Prize Recipients acknowledge that the Major Prize will be taken as a group hosted by the Promoter and its ambassadors. Additional spending money, meals, taxes (excluding airline and airport taxes), transport to and from departure point, additional insurance, passports, visas, vaccinations, any additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

    Prize must be taken between 19/07/2025 and 26/07/2025 and is subject to booking and flight availability. The Prize Recipients are responsible for ensuring that they have valid passports (with 6 months validity from the date of scheduled return to Australia), and any requisite visas, vaccinations and travel documentation. Prize Recipients must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Major Prize. Major Prize is subject to the standard terms and conditions of individual prize and service providers. Prize Recipients may be required to present their credit card at time of accommodation check in. Prize Recipient must finalise the booking within four (4) weeks of being verified as a Prize Recipient. Prize Recipient must meet the eligibility requirements of the ESTA Visa Waiver for entry into the USA and will be responsible for securing their ESTA Visa Waiver, at their own expense, prior to their trip. Prize is a single-event holiday and cannot be separated into different holiday vacations. Once booking is confirmed, no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur a fee of $200 per person including GST plus supplier charges which is payable by the Prize Recipient. The Prize Recipient and their guest agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation apart from the Promoter or Mavel Group.

  31. The Tales of the Cocktail 2025 seminars event prize component is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any Prize Recipient for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
  32. Second Prize

  33. The Second Prize includes a two (2) night stay at Thredbo, NSW valued at up to $9,300 depending on date and point of departure.
  34. Each Second Prize is for two (2) adults aged 18 years or over and includes:
    • Two (2) x return economy airfares from the Australian capital city nearest the winning Eligible Venue to Canberra, ACT;
    • Three (3) days car hire;
    • Two (2) nights accommodation in a minimum 3star alpine lodge in Thredbo (twin or double share). Must be mid week during the shoulder season;
    • Daily National Park entry with access to Kosciuszko's National Park;
    • Daily ski pass for two (2) adults;
    • A premium dinner for two (2) adults;
    • Comprehensive travel insurance with snow cover (subject to the travellers having no pre-existing medical conditions and being under the age of 59years).

    Prize must be taken between 01/08/2025 and 31/08/2025, mid week and during shoulder season. Spending money, additional meals, taxes (excluding airline and airport taxes), transport to and from departure point, additional insurance, any additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

    The Prize Recipients are responsible for ensuring that they have valid travel documentation. Prize Recipients must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Major Prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Prize Recipients may be required to present their credit card at time of accommodation check in. Prize Recipient must meet all car rental conditions prescribed by the car rental company. If the Prize Recipient is ineligible, they must nominate a guest who meets the conditions. Prize is a single-event holiday and cannot be separated into different holiday vacations. Skiing and other winter activities are considered dangerous activities. The Prize Recipient and their guest acknowledge that participation is at their own risk and agree to:

    • Not participate while under the influence of drugs or alcohol.
    • Comply with all safety briefings, training, and equipment requirements.
    • Accept that the Promoter and Activity organisers reserve the right to prevent participation if safety concerns arise.
    • Once booking is confirmed, no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur a fee of $200 per person including GST plus supplier charges which is payable by the Prize Recipient. The Prize Recipient and their guest agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation apart from the Promoter or Mavel Group.

    Third Prize

  35. The Third Prize includes a team boat day (chartered boat trip) for up to ten (10) adults on a private sailboat for a total of four (4) hours, including a professional cocktail bartender to mix and serve for the duration of the prize valued at up to $7,500. Prize includes food, alcoholic and non-alcoholic beverages for the duration of the chartered boat trip.
  36. Prize must be taken by 28/02/2026.
  37. Mavel Group will select the supplier and work with the winning Eligible Venue to deliver the experience on their preferred dates, subject to vessel availability. However, the vessel and availability of preferred dates cannot be guaranteed. The guest(s) agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation apart from the Promoter or Mavel Group.
  38. If the winning Eligible Venue cannot attend this prize the Promoter will award the winning Eligible Venue an alternate prize of cash to the same value. In the event cash is awarded, the cash prize will be awarded to the winning Eligible Venue's business account via Electronic Funds Transfer. An Authorised Person on behalf of the winning Eligible Venue will be responsible for providing full and accurate bank details. The Promoter will not be responsible for incorrect details being provided, a banking institution rejecting an EFT payment, or any costs associated with locating any lost monies.
  39. Fourth Prize

  40. The Fourth Prize includes a Hijinx Hotel team escape room challenge (two (2) hours) for up to fourteen (14) adults including food served at Hijinx Hotel valued at up to $2,400. In the event there is no Hijinx Hotel within a reasonable distance of a winning Eligible Venue, the Promoter will award the winning Eligible Venue an alternate prize of cash to the same value. In the event cash is awarded, the cash prize will be awarded to the winning Eligible Venue's business account via Electronic Funds Transfer. An Authorised Person on behalf of the winning Eligible Venue will be responsible for providing full and accurate bank details. The Promoter will not be responsible for incorrect details being provided, a banking institution rejecting an EFT payment, or any costs associated with locating any lost monies.
  41. Prize must be taken within 12 months of winner notification.
  42. For winning Eligible Venues located in Tasmania and the Northern Territory, equivalent activity funds will be provided to host a similar team activity in their location. The guest(s) agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation apart from the Promoter or Mavel Group.
  43. Fifth Prize

  44. The Fourth Prize is $500. Cash prize will be awarded to the winning Eligible Venue's business account via Electronic Funds Transfer. An Authorised Person on behalf of the winning Eligible Venue will be responsible for providing full and accurate bank details. The Promoter will not be responsible for incorrect details being provided, a banking institution rejecting an EFT payment, or any costs associated with locating any lost monies.
  45. General

  46. Where the prize includes insurance, the Prize Recipients will each be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter's nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter's nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter's nominated travel insurer refuses to issue insurance to the Prize Recipients, the Prize Recipient forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter's nominated travel insurer, including but not limited to any limitations on the covered amount.
  47. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Venues (including Authorised Persons, employees, purchase history and sales records) and reserves the right, in its sole discretion, to disqualify any Eligible Venue, Authorised Person or employee who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  48. Incomplete, indecipherable, unviewable or illegible entries, including content submitted as part of a Challenge, will be deemed invalid.
  49. This is a game of skill and chance plays no part in determining the winning Eligible Venues.
  50. The Promoter's decision is final and no correspondence will be entered into.
  51. In the event of war, terrorism, state of emergency, government lockdown, pandemic or any other kind of disaster or unforeseeable event beyond the Promoter's reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend, substitute or modify a prize.
  52. Entry and continued participation in this promotion is subject to the licensee's liquor serving policy. The Promoter advocates the responsible service and consumption of alcohol.
  53. If for any reason an Eligible Venue does not take / redeem a prize (or an element of a prize) at / by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  54. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  55. Total prize pool value is up to $83,500. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  56. Authorised Persons on behalf of an Eligible Venue agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Authorised Persons warrant and agree that:
    • they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 18, or otherwise unsuitable for publication;
    • their Content shall not contain viruses or cause injury or harm to any person or entity;
    • they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
    • the Content is the original artistic/literary work of the Eligible Venue that does not infringe the rights of any third party;
    • they consent to any use of the Content which may otherwise infringe the Content creator's/creators' moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
    • they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
    • Without limiting any other terms herein, Authorised Persons agree to indemnify the Promoter for any breach of the above terms.
  57. As a condition of entering this promotion, each Authorised Person on behalf of an Eligible Venue licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  58. Authorised Persons, on behalf of an Eligible Venue, consent to the Promoter using their name, likeness, image and/or voice in the event they are a winning Eligible Venue (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  59. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Authorised Person or Eligible Venue; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  60. Any cost associated with accessing Instagram is the Eligible Venue's responsibility and is dependent on the Internet service provider used.
  61. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the Eligible Venue. Authorised Persons, on behalf of an Eligible Venue, should seek independent financial advice in this regard.
  62. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  63. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any experience associated with a prize is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winning Eligible Venue, Authorised Person or Prize Recipient; or (g) use of a prize or participation in a prize.
  64. As a condition of accepting a prize an Authorised Person on behalf of the winning Eligible Venue or a Prize Recipient (where relevant) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  65. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.williamgrant.com/gb/privacy-policy/. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, with your specific consent, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant's personal information to any entity outside of Australia.
  66. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Instagram Terms of Use, which can be found at http://instagram.com/about/legal/terms/.

Entrants understand that they are providing their information to the Promoter and not to Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Instagram. Instagram will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
